IN THE CIRCUIT COURT NO. 4 FOR CLARK COUNTY STATE OF INDIANA IN THE MATTER OF THE CASE NO. 10C04-2607-AD-000039 ADOPTION OF: E'VORI CHRISHAWN BRIGGS TO: NOTICE TO MOTHER AND PRESUMED FATHER Felisha Sturgon, Biological Mother Myriha Treat, Presumed Father Notice by Publication That FELISHA STURGON and MYRIHA TREAT, the Biological Mother and Presumed Father of the child born to Felisha Sturgeon on July 14, 2011, or any person who claims to be the father of the child born to Felisha Sturgeon on July 14, 2011, is notified that a Petition for Adoption of the child was filed in the Office of the Clerk of Clark County, in Jeffersonville, Indiana, 47130. The petition for adoption alleges that the consent to adoption of the child is not required per Indiana Code 31-19-9-8(a)(2) and (b) because Petitioner has been the minor's guardian for a number of years and neither parent has had meaningful contact or provided for the support for the child for a period exceeding one year. If either party noticed herein seeks to contest the adoption of the child, he/she must file a motion to contest the adoption in accordance with Indiana Code 31-19-10-1 in the above-named Court within thirty (30) days after the date of service of this Notice. This Notice may be served by publication. If either party noticed herein does not file a motion to contest the adoption within thirty (30) days after service of this Notice, the above-named Court shall hear and determine the Petition for Adoption. The party's consent is irrevocably implied and the party will lose the right to contest the adoption or the validity of the party's implied consent to the adoption. The presumed father also loses the right to establish paternity of the child under I.C. 31-14. Nothing anyone says to the parties noticed herein relieves said parties of his/her obligation under this Notice. No oral statement made to either party noticed herein relieves him/her of his/her's obligations under this notice. Under Indiana law, a putative father is a person who is named as or claims he may be the father of the child born out of wedlock but who has not yet been legally proven to be the child's father. This notice complies with IC 31-19-4.5-3 and IC 31-19-4-4 but does not exhaustively set forth a person's legal obligations under the Indiana adoption statutes.
